That's the almost exact wording of the mud guard requirement in the ADR's . That's across the board everywhere like that.
Is there not something about a 70kg weight on the seat at the time of measurement aswell???, as a weight would affect the results significantly.

No as the Axle hight doesn't change with or without weight... I Hope.

But the rear mudguard bit would get closer to the wheel with a rider on board..

From memory it's unsprung weight. The angle on most bikes gets more legal(for want of a better term) as the guard comes closer to the ground . So with swingarm bikes that unsprung angle is the one they take as the angle decreases with weight on the seat .
