Hope this is cool but I have been reading some posts about the new Anti-Hooning laws on some other sites and thought I would share what I have been reading with you. It seems now the police are stopping both cars and bikes they feel maybe driven by hoons ... you dont in fact have to be doing anything wrong ... they then will take pictures of the vehicle and you for there hooning database and if they "suspect" anything is not standard on your vehicle they will then have the right to impound it for 48 hours for inspection. They dont in fact have to do anything other than say I suspect you have an exhaust thats too loud in order to confiscate your vehicle. I dont know if this is all true but from what I am reading they are already setting up roadblocks at places like Mt Glorious and photographing riders ...

POLICE POWERS AND RESPONSIBILITIES ACT - SECT 82
82 Content of notice for motorbike noise direction offence
(1) This section applies if a motorbike has been impounded because a police officer reasonably suspects the driver of the motorbike has committed a motorbike noise direction offence.

(2) The impounding notice must state--

(a) that the motorbike is impounded for the initial impoundment period; and
( the prescribed impoundment information; and
© that an application will be made to the relevant court for a noise abatement order within 48 hours after the end of the impoundment period.

Ok its not likely that we can stop what is happeneing to us as individuals.
So I have done a little research and we can take some action tho limited.

The Queensland Council for Civil Liberties want to hear from you all whats been going on. If enough take the time to email them the ball may start to roll.

Dont tell them how you were doing 300kph and it was on a country road and was safe. This is for the harassment side of things, like the photographs they are taking that is a breach of your Civil rights.

If I remember correctly the whole photo thing is so the Police have a database on who rides what & wearing what. Apparently no two riders wear the same leathers, helmet and have matching bikes. If they do they are very few and far between.

So if they can't catch you, they can track you down via the picture database. And the more I think about it, how much of it will be use in conjunction with the whole speed camera problem & no front number plates. You can still be photographed by the speed camera, but because you don't have that front number plate they can't track you. Now if they cross referance the Speed Camera photo with their bike, rider & gear database there is a very good chance you will be found.

Thats a scary thought. Someone dressed similar on a similar bike, not yet in the database breaks the law and you get the infringement notice since you were the closest cross match in the database.

I could be wrong, but I wouldn't be surprised either.

Yeah well as I’m sure some of you are aware, I found myself getting photographed on the weekend after being pulled over for no real reason and yes I do believe what you are saying is somewhat true …. I know guys with seriously modified bikes that happily cruise to and from work day in day out without so much as getting looked at but if you are hanging about in known “Hooning” areas and at known “Hooning” times "as I was" its always going to attract a little extra attention and I guess its just common sense.
I’m more than happy to forward my experiences to the posted address in the hope of helping someone else in the future but I won’t be holding my breath for any changes.
My bigger fear is what this “data base” will eventually be used for????
The very first knock on the door asking my whereabouts on a certain day at certain time will confirm my concerns I guess…….still, I think it would be very interested in seeing them prove it?

Simple - Police pull you up merely to investigate an offence against the Road Use Management Act . This is a police state. They have powers way beyond what you may realise. Your bike may be impounded just because a cop believes you are a hoon or a police officer reasonably suspects the driver of the motorbike has committed a motorbike noise direction offence......... They take one look at me and automatically think hoon. YOU cant win - far better to just keep out of their way in my opinion.





POLICE POWERS AND RESPONSIBILITIES ACT 2000 - SECT 54
54 Power of inquiry into road use contraventions
(1) It is lawful for a police officer to make any reasonably necessary inquiry, investigation, inspection, examination, or test for establishing whether or not an offence against the Road Use Management Act has been committed.

(2) Also, it is lawful for a police officer to arrange for someone else to make any reasonably necessary inspection, examination, or test for establishing whether or not an offence against the Road Use Management Act has been committed.


A General Defining of Police Harassment-
Unfair treatment conducted by law officials including but not limited to excessive force,profiling, threats, coercion, and racial, ethnic, religious, gender/sexual, age, or other forms of discrimination. Being pulled over and questioned is NOT harassment. If you get pulled over every day, without probable cause, then that is.

They may be able to take piccies but that will never hold up in court unless your rego plate is seen in the pic.
It refers back to the previously mentioned scenario of someone being able to dress the same and wear the same helmet etc.

Our "individual" bikes could pose a problem though, that respect.

It still sucks. I'd refuse the photo if they wanted it taken and hand them my solicitor's card.
Better yet, is there a solicitor on this forum who can shed some legal light on the matter?

I have not known anyone to get the bike impounded yet but I know a lot of guys that have been photographed and are on the "database" and a guy at work has had his car impounded ...

I didnt get my pic taken but was told because I did a 100m fishy up the road infront of an unmarked cop car, that I was on the "database" and would have my car pinched if I did it again.

If I get pulled over on my bike and they want to take a pic of me in my gear I'll already have my jacket off (head start) and if they whip out the camera I'll strip down to my jocks and stuff my gear in my backpack. then pose :D the fuckheads.

No it didn't get impounded... He wanted too... but Simon talked him around by apparently being recorded saying he would ride it to a local shop and arrange transport for it...
Remember that Simon works for a shop and that bike is regestered to a shop so he could tell all kinds of stories to effectivly distance himself from the situation a bit...

Locally one of the guys that rides with us all has had his R1 impounded for 48 hrs... Completly stock bar a set of slip ons...
they locked it up in their garage and didn't touch it he said.
He has just gone to court for his offence.They locked it up on the spot when they caught him about 2 months ago.

Ignore the cops, don't stop for them. If stopped I would state politely I am going straight home to rattle can my bike and change what I am wearing including my helmet. This is why I don't vote. Did anyone see that idiot cop last night on tv "chase" some guy doing 105 on the freeway? Now that cnut cop should be locked up for hooning, fucking starsky and hutch wannabe.

I watched that on ACA last night ,the bloke he pulled over after chasing him was on a yellow speed triple,that cop was well out of order,driving with one hand ,over taking on the left putting other motorists at risk and wearing a Holden Racing lanyard around his neck.[:o)].

Well it's 5:30 on a fucking sunday morning and I'm fucked off!!!! Been awake for an hour and a half now trying to get back to sleep but no go. Some FUCKHEAD just pulled a fuckin great burnout right in front of my house, woke up both me and the hugs and kisses then fucked off only to come back and do one the other way. AT FOUR O'CLOCK IN THE FUCKING MORNING FUCKING TOSSER!!!!!!!!!! I'm as much for a good burnout as the next guy (take a look at the sig) but for fuck sake grow some nuts and do it at the track or an empty industrial zone or some dedicated event ya fucking legend. Now we got a cop shop at the other end of our street and did they come to check it out?? No of course they fucking didn't (probably eating from the krispy kreme that just opened up the other side of the suburb). But then they probably wouldn't book him anyway cause he's still got his original fucking mud-guards. I'm tempted to take a leaf from Azraels book and throw a brick at him next time he comes round. CUNTBURGER!!!!!!!!!!!!

This happened to me one night, 4am too. One ripper of a burnout outside our hose. Woke the shit out of me and the missus. Then the arsewipes u-turn go back and do it again. Except this time there was a mighty kerthump - they blew the diff.

Oh joy, says me. Clothes on, pass through the garage to pick up a claw hammer, outside leap the fence and there is these 3 silly fuckers pushing there car up the road. Up the wrong side of the road towards the corner mind you.

So it may have been the crazy look in my eye, or the fact that I explained that I broke the claws off the hammer last time some little c^nts were doing burnouts in my street, but you know what? They haven't been back :(

They went pretty white too, now that I think about it :D

I had some cunt do it in my driveway, and I don't live in an industrial area either, I live in a pretty good area. I live on a hill and have a long steep driveway and the fuckers drove all the way up to the top and let rip. I was waiting for them to come back but they didn't. The next day there was a dumped, trashed car (I'd say hot) so I reckon I got it easier than the poor bastard who had some junkie fuckwit kid rip off their car.

when a cop is going to confiscate(which means 'take without clear lawful authority'), they always ask 'i am now going to confiscate your bike for blah blah, do you understand?' understand means " stand under" or submit to, ALWAYS say no if any officer of the state asks if you understand, they cannot take further action till you do, some will but it is unconstitutional.

It was a wanker here in perth kneeling on the tank going through the same speed camera over and over giving it the bird, they offered a dob in reward and had over 30 people give up the same guy from memory(how good are your mates now cockhead), he had other warrants and was chucked away for a while.
There was a second person in the original news print riding with him doing the same thing who never got caught, well that im aware of.
I kept the article somewhere, ill try and find it and post it, its a pretty funny read not only because the guy got caught being a fucken twat but also for the appauling attempt at journalism that is the west aus newspaper..

Now fair enough its not exactly stock but ive been getting first hand storys from riders copping work orders on bikes that are anything from bog stock (one in particular on a brand new bike)to heavily modified bikes the likes seen on here.
Its becoming increasingly difficult not to see WAPOL as anything more than a revenue machine as with most states, however the root of our problem starts and ends with a particular single celled organisim named grant dorrington who thoughout his term as the exulted leader of the road safety council of wa (an organisation with the brains trust of a foam cup filled with nail clippings) has made quite clear that in his attempt to have zero road deaths in wa he must remove all two wheeled machines to do so.
The man is a fuckmuppet and has failed so badly at trying to stop our road toll its difficult not to feel that this is nothing more than a parting shot at two wheeled enthusiasts before he hands over control to the new heir to the throne of EPIC FAIL.

To be honest if he wasnt such a waste of oxygen id feel sorry for the guy. Its a shit job, but there's a right and a wrong way to go about anything and he just targeted a minority road user with a high fatality rate without considering causality and proceeded to attempt to cleanse it, ethnic style..

Must suck to be that bad at your job..

What I am told here is that police have the right to take anything they want as long as they say they are "gathering evidence" and believe that there is a problem with your vehicle. I think thats why they can hold it for 48hrs but even if it isnt roadworthy they must return it to you in order for you to fix it up. I think if they are charging 650 bucks to hold it .. thats damn rude if they find no faults or issues with the bike ... But we do live in communist Australia so what do you expect 8) ?
