Hope this is cool but I have been reading some posts about the new Anti-Hooning laws on some other sites and thought I would share what I have been reading with you. It seems now the police are stopping both cars and bikes they feel maybe driven by hoons ... you dont in fact have to be doing anything wrong ... they then will take pictures of the vehicle and you for there hooning database and if they "suspect" anything is not standard on your vehicle they will then have the right to impound it for 48 hours for inspection. They dont in fact have to do anything other than say I suspect you have an exhaust thats too loud in order to confiscate your vehicle. I dont know if this is all true but from what I am reading they are already setting up roadblocks at places like Mt Glorious and photographing riders ...

POLICE POWERS AND RESPONSIBILITIES ACT - SECT 82
82 Content of notice for motorbike noise direction offence
(1) This section applies if a motorbike has been impounded because a police officer reasonably suspects the driver of the motorbike has committed a motorbike noise direction offence.
(2) The impounding notice must state--
(a) that the motorbike is impounded for the initial impoundment period; and
( the prescribed impoundment information; and
© that an application will be made to the relevant court for a noise abatement order within 48 hours after the end of the impoundment period.

Ok its not likely that we can stop what is happeneing to us as individuals.
So I have done a little research and we can take some action tho limited.
The Queensland Council for Civil Liberties want to hear from you all whats been going on. If enough take the time to email them the ball may start to roll.

Dont tell them how you were doing 300kph and it was on a country road and was safe. This is for the harassment side of things, like the photographs they are taking that is a breach of your Civil rights.

If I remember correctly the whole photo thing is so the Police have a database on who rides what & wearing what. Apparently no two riders wear the same leathers, helmet and have matching bikes. If they do they are very few and far between.
So if they can't catch you, they can track you down via the picture database. And the more I think about it, how much of it will be use in conjunction with the whole speed camera problem & no front number plates. You can still be photographed by the speed camera, but because you don't have that front number plate they can't track you. Now if they cross referance the Speed Camera photo with their bike, rider & gear database there is a very good chance you will be found.
Thats a scary thought. Someone dressed similar on a similar bike, not yet in the database breaks the law and you get the infringement notice since you were the closest cross match in the database.
I could be wrong, but I wouldn't be surprised either.

Yeah well as I’m sure some of you are aware, I found myself getting photographed on the weekend after being pulled over for no real reason and yes I do believe what you are saying is somewhat true …. I know guys with seriously modified bikes that happily cruise to and from work day in day out without so much as getting looked at but if you are hanging about in known “Hooning” areas and at known “Hooning” times "as I was" its always going to attract a little extra attention and I guess its just common sense.
I’m more than happy to forward my experiences to the posted address in the hope of helping someone else in the future but I won’t be holding my breath for any changes.
My bigger fear is what this “data base” will eventually be used for????
The very first knock on the door asking my whereabouts on a certain day at certain time will confirm my concerns I guess…….still, I think it would be very interested in seeing them prove it?

Simple - Police pull you up merely to investigate an offence against the Road Use Management Act . This is a police state. They have powers way beyond what you may realise. Your bike may be impounded just because a cop believes you are a hoon or a police officer reasonably suspects the driver of the motorbike has committed a motorbike noise direction offence......... They take one look at me and automatically think hoon. YOU cant win - far better to just keep out of their way in my opinion.

54 Power of inquiry into road use contraventions
(1) It is lawful for a police officer to make any reasonably necessary inquiry, investigation, inspection, examination, or test for establishing whether or not an offence against the Road Use Management Act has been committed.
(2) Also, it is lawful for a police officer to arrange for someone else to make any reasonably necessary inspection, examination, or test for establishing whether or not an offence against the Road Use Management Act has been committed.
A General Defining of Police Harassment-
Unfair treatment conducted by law officials including but not limited to excessive force,profiling, threats, coercion, and racial, ethnic, religious, gender/sexual, age, or other forms of discrimination. Being pulled over and questioned is NOT harassment. If you get pulled over every day, without probable cause, then that is.
