Can you over tighten the swingarm pivot ? Do I just do the nut up flat-out against the shaft ?

Howdy mozza, I don't think you can over tighten an EF/GSX pivot, (ie: do it up so tight that it doesn't move), as for how tight, I've only ever used a 1/4 inch drive ratchet on it with no Torque setting, just nice n snug does it for me, even did it this way when my EF was being raced in A/SB.

GSX1100EF Swingarm Pivot Bolt Nut: 50-80 Nm of Torque as per the Manual.

there is a crush tube and the spacers that run in the needle bearings so you should be able to do it up tight if you do it up tight and the swingarm becomes stiff there must be a spacer issue
