JUST THOUGHT I SHARE THIS FROM ANOTHER FORUM,
I received the email below from the MCC regarding an entrapment of motorcyclists on the Old Pacific Highway, that I thought you might be interested in.

You may be interested in a little scam and entrapment exercise the NSW Highway Patrol have been running recently on the old Pacific Hwy at Mooney Mooney just North of the Hawkesbury River.

The Old Pacific Hwy is a favourite for motorcycle riders on weekends and many hundreds will make their way along its scenic winding length visiting the cafes and restaurants, meeting and socialising, particularly when it is a fine sunny day as it was last Sunday (Sept 16th 2012).
Taking advantage of the fine warm conditions the NSW Highway Patrol set up a TRAP for Motorbike Riders where they waited on a gravel verge in a grey Nissan X-Trail SUV for riders to round a bend whereupon the Nissan SUV blasts off the verge in a shower of dust and accelerates into the path of the Riders then suddenly slowing and forcing the riders to either brake heavily or if they think the SUV is actually politely waving them past, actually overtake by momentarily crossing the double white lines, which can be done very quickly and safely (on a motorbike) and is what my companion, I and many others did on the day.
The sting then takes place a few kilometres down the road where a couple of Highway Patrol cars pick up the riders and book them after being radioed their details by the SUV team who have recorded the whole shabby ENTRAPMENT exercise on video.
We would like to request that other parties such as perhaps yourself who are interested in the appropriate and ethical application of the law and traffic regulations for the good of the community and not just the revenue target needs of the NSW Highway Patrol and the NSW State Government, could ask the NSW Highway Patrol how this ENTRAPPMENT sting really contributes to improving road safety and what impact it will have on the reputation of the Police in the community being targeted by this shabby revenue raising scam.

I am also looking to find as many other riders caught up in this scam and put together a formal joint complaint and legal response and would appreciate it if you could distribute this message.

I was up there on sunday and I had a hunch something was going on. (Benifit of being an old hand on that road) But I didnt hang around to find out what it was. Usually when I smell trouble I bail out.

The reason for this is 1 the nazi HWY patrol thugs and 2 the Gosford magistrate who is a dog of a human and has an overt hatred for bikes.
Its never been unusual for the fuzz to employ dirty tactics to catch riders. Anyone who hung around when Max owned the Road Warriors and rode the slab all day can attest to that.
My advice is just dont go there. Yes the cops are being dirty but its always been the way. Waterfall natio is the same now too. And its because of crash statistics not skilled riders.

Just a word of encouragement regarding police actions at the moment. Fight your speeding tickets. This is exactly what they don't want you to do and the reason they are getting away with such unscrupulous behaviour. They are relying on you to simply pay fines, raise their revenue and you go away.

There are a few people out there willing to help you with fighting fines and these guys are getting 90% plus win results.

Much of this behaviour from the traffic branch is outside the guidelines of the Police Commissioner rules and guidelines. Remember they are bringing a charge to you, all you need to do is give the court reason enough to doubt the charge or practices of the cops.

Take it to the courts, in countries they see higher challenge rates then Australia, they are seeing a reduction in the use of roadside speed camera due to not being worth the effort.

Take it to court, you have nothing to lose other then taking a day off work.

best way ive found to beat acop,after he says i clocked you @ or do you know how fast you were going ,i dont tell them what they want to hear ,i say my GPS speedo was show ,this,in this speed zone ,they tend to pull back when you tell them you know exactly what speed you were doing
for example i had a cop telling me i was doing 190ks in january this year ,i laughed at the guy ,and said ,i know i was doing 105k in
a 100 zone ,he got angry ,bc he never used the radar and was hoping id put my foot init ,i dont admit to the cunts,i got stopped in my 300zx by a bitch ,yelling at me telling me it is a 50 zone ,i told her that my speedo was indercating i was doing 40ks ,she got the shits and tryed to defect the car ,which failled ,there retards

That'll work some of the time when they have no accurate speed device on you, but they have the power to estimate speeds, write the ticket and take it to a court if they wish. When you get to a court, the magistrate is obligated to believe the cop rather then you unless you have a great defense.

Point being that they will get away with this with most of the people, and unless the greater community start fighting back, imagine what they will be like in 10 years from now? Remember what it was like 10 year ago compared to now?

There are strict guidelines and requirements the traffic branch must follow in order to book you, many of these times they do not follow these guidelines. Don't play their rules, take it to court.

I took one to court 2009, didnt win but ended up dropping $200of the top of the fine, didnt get any points, and didnt have to pay court fees.
Tha courts there to be used, just be dam sure in what your sayin hasnt bin pre recorded by them..

In previous threads you say you get targeted by the local cops so your bike has to be road worthy, well if this is the way you converse with your local cops you deserve anything and every thing you get Pete.

You need to remember cops are people too and like the rest of us don't appreciate smart arsed pricks when your at work, the only difference is what they say holds more weight than you or I purely because of their role in society.

The WPC probably wanted to defect your car because you were being a smart kunt and that made her day that little more shit so was eager to make yours likewise.

I have always found that a non confronting tone and body language mixed with no bull shit gos along way to not getting a ticket and a blind eye given to the fact I have no mirrors, indicators, horn and a Simpson helmet on let alone all the other things not to spec on my Fighter.

All this said just like the rest of society there are bogan cops too that are commonly hated by their peers because they make joe citizen hate cops and have a fucked up attitude like yours and many others.

Just a little something to think about next time you get pulled up.

Dylan ,you need to know me before you start to comment on my de meaner ,quiet frankly sick of it ,look ,im polite and friendly but never admit a thing to said officers ,so enough of the character bashing, the RMS cannot just make up reasons to defect a car in n.s.w ,also having an officer with a noise metre telling me to rev my car to 3500rpm for a noise test is a joke as it must be done as stated in an rms rule book not by a jockey holding the metre 2inches from the rear of my old 300z ,and that is at 90ks an hour from a distance of not more then 5 metres ,how do you think they pas all these shit box noisy diesel,s
my attitude to police isnt fucked up,my view of them never changes ,the fact is the fat woman next door rings and complainsabout any and every motorbike she hears ,as she told me this 4 weeks ago ,funny thing is since ispoke to the local area hwy command ,myfriends and myself have been left alone ,as they relise she is just a bike hating person
ok let me put this to you ,i got stopped 18months ago in traffic by an officer who almost rammed the car behind me to get behind me ,i was doing 80 in aline of traffic in a 100k zone,after i stopped ,he looked all over my bike told me it was alovely bike ,asked for my licence went back to his car ,fastforward 5 mins ,he comes back ,blow in this ,please,no probs,at this point i hadnt saida thing,after the reading comes back at ,0, he then handsme a ticket for 86 bucks and 1 point for a point on my chain guard ,wtf i think to myself ,i said nothing to him ,all hewas doing was raising money,.

i got a phone call re-garding said operations today ,the head of the gosford highway patrol ,he told me today that he knew of said operation ,but it was in-fact the Hornsby highway patrol,he stated he knew they were in his area of operation and that the complaint is being taken seriously ,and further more he stated that the officers involved "may have miss understood there roll in said operation's,

Local cops dont seem to bother me , but they all know I'm a silly old bastard and dont "Hoon about town". Had a few pull me over and look over the bike with intent in they're eyes, once I pull of the helmet they must take pitty on me (must be my age or ugly mug) as they usally relax and ask WTF is it ?

No bullshit seems to work fine here , I tell em nope exaust is far to loud ment to have a rear gaurd to here etc etc , Move along have a nice day is able all I get. Last fine/warning was almost 12 months ago in a stock looking corolla of all things.

12mths ago, he reckons he didn't normally pull people up just to tell them they ride like a champ and their devilishly handsome but he saw me ride past and got hard.
What can I say a fully sick Suzuki Streetfighter will even do that to the bronze, they are only human.

Cops will pull you over if they see you doing something stupid, Traffic branch will pull you over to fill their weekly quota.

i would have to agree with weasel on this point , if you give them respect and dont lick there jack boots they usually are good to you ,



i got pinched doing just under 20 over in feb this yr and i talked to the cop and was honest and he droped the fine down for me which he didnt have to do that at all ,

Personally I reckon it's just hit and miss you get some good ones some bad ones and some robots.

I got done for 20 over last year on the hwy and I got a fine that was it, they weren't pricks about it or anything but it still cost me enough.

2 days later heading to the shops I parked and this unmarked came up behind me all excited like, first up they commented on my speed taking off from the lights, didn't speed just reached the speed limit very quickly, then they started looking for something to fine me for, absolute dogs, anyway I'd forgotten to put my new rego sticker on so got that, turned out they were from out of town.

No doubt there's varying degrees in the job, but don't forget the reduction in the offence is taught to them as a de-escalation technique to reduce the roadside flairups and help their public image.

Did you end up taking this to Court? what was the outcome? The cops have started using this very same entrapment excercise in Wollongong too and it is excactly as you have described above. I am very interested to get more info if you took it to court as i am seriously considering doing the same. Cheers!

I also got stung on the w/end by this method (Mac Pass). I had a quick look at the 'net and (because I believe everything I read) I wont be holding my breath for the "entrapment" defense to save my hard earned from buying them donuts. Entrapment means they used illegal methods to gather evidence to be used against you. Try proving that in court! Im not saying how they go about it isn't a cunt act, it's just not illegal. And go introduce yourself, before you cop a flaming!
