Well i think we can all work it out from the title... my SV is broked again :(

I am fine apart from a slightly squashed thumb. (might be broken, getting x-rays today.)

So here's what happened.

The scene if the crime:

Traffic was as it is in the photo. I went up the right "lane" (which, since speaking to hwy patrol, is in fact a legitimate lane, no recommended but legal), guy decides to park in the middle and BAM!

Looks like it will go through his insurance (probably with some arguing to me) and that will mean the bike will get written off. (frame scratches) Hopefully if that happens i can buy the wreck back and get another bike to put my tail/exhaust that i put so much effort into on.


Already looking at other bikes.

There is this one just up the road from me, and if i could find a frame with a clear title would be perfect!

Good to hear you are ok, it sucks but there is a silver lining.......... new bike new mods and ideas etc
oh and as Kato said rip them a new one.

it's apparenlty designed so that people pulling out of the middle parking don't have to pull into the main flow of traffic before they can see what's going on... kind of to stop people from driving cars right hard up against parked traffic.

well the father of the guy who hit me (the owner of the car) and the guy are being DICKS!

Won't give me a claim number and the rego and business name don't show up for RACV or RACV business (who they said they are insured with)

Time for a letter of demand i think.

I have recieved a call from IAG about the claim (so they actually did put one in) and they started by pretty much asking me how i was going to pay for it, so obviously i told them that i wanted to fight blah blah blah, i have emailed them my record of events to be argued with the insured. hopefully i can get the HWY patrol to pull through with a stat dec that the piece i was on is a lane by the legal definition. Otherwise i may need to lawyer up to argue that.

If the Police rule that you are in the right it's game over for the insurer. I would not talk to them. Send them a letter of demand instead. They will try to bully you but they can't ignore the letter of demand addressed to their insured they have to respond to it. get onto the copper and chase his report. Once you have that they will pay up.

hey mate having been through this if the cops attended all you need to do is provide your insurance company with the police report number and from there your insurance can obtain all the details of the vehicle involved, insurance company, driver etc.
you cannot access the other partys details from this due to the privacy act but you only require them if you want to sue. if its just for your insurance to claim back on your bike then the police report number is all you need.

i know you're in vic, but in NSW, if one vehicle has to be towed, the cops must charge someone with neg driving. When i was hit by a car in 06, it broke my front brake lever so i couldn't ride it. I made sure the driver got charged, to make it easier with her insurance. Is it similar in Vic?
What about NSW rules like failing to indicate before changing lanes or failing to give way before changing lanes, etc.
Also keep a record of medical bills, cab fares for transport since your bike is busted, etc.
Insurance companinies never admit fault, they they willtry and make you give up. Keep all explanations simple, ie heading straight ahead in the right lane, and the driver suddenly turned accross my lane (without due care).

Like the other guys have said, glad you're ok, and send them a letter of demand.

Fuck dude, hope the bastards pay up. Passed by yesterday but u were out getting the bike back. Today finished quite late from work. Will try and pop by tomorrow.

no actual police report guys. the police didn't attend as there were no injuries... well i don't consider my squished thumb a real injury.

I'll go back to the cop shop where the HWY patrol told me it is a lane and see if i can get a stat dec off them to say it is a lane, then i will send through a letter of demand with that attached.

Yeah thanks for dropping over jules. i'll be home tonight so feel free to drop by and see the broken bike :( and i might even give you your tent this time.

i'm hoping it gets written off and i can buy it back then use the exhaust/tail on another bike. all of the bits that i have actually made came through unscathed. so i'm pretty happy about that.

Any wonder you had an off Trav, the streets here are fucked. I tried for 45 mins to get to Peter Stevens MC today but got led around in circles in the most backwards fucked up street setup I have ever experienced in the end I gave up.. Melbourne can suck my balls.

I was gonna spread the word Mate, and try and catch up with some Mexicans but I got a pretty full schedule with the Wifey, yay for me lol so I thought I better not sort anything save disappointing any of ya'll (you know cos I'm so uber special and all).. The 11 hour drive here was far less painfull than the hour in the city and all I could think of was no wonder some prick hit Trav!
